These Terms of Service govern purchases from and use of the Papa Diaries online store.

By placing an order through our website, you agree to these Terms together with our Refund & Returns Policy, Shipping & Delivery Policy and Privacy Policy.

1. About Papa Diaries

Papa Diaries is an online jewellery retailer operating from Malta.

BEFORE PUBLIC LAUNCH:
Insert the legal name of the trader operating Papa Diaries and the legally required geographic/business address and, where applicable, company registration and VAT information.

2. Online Store

Our website allows customers to browse and purchase jewellery and related products offered by Papa Diaries.

We currently sell and deliver through our online store within Malta.

3. Product Information

We make reasonable efforts to describe and photograph our products accurately.

Because jewellery may include natural, handmade, textured, painted, plated, stone, pearl-effect or other materials, minor variations in colour, texture, finish or appearance may occur.

Colours may also appear slightly different depending on lighting, photography and the customer's display.

Nothing in this section limits a customer's rights where a product materially differs from its description or does not conform to the contract.

4. Prices

Prices are displayed in Euro (€).

The final price, including applicable taxes and any delivery or other additional charges, will be displayed before the customer confirms the order.

5. Orders

Submitting an order constitutes an offer to purchase the selected products.

An order is confirmed when it has been accepted through our checkout and the appropriate order confirmation has been issued.

We may be unable to accept an order where, for example, a product is unavailable, payment cannot be authorised, an obvious pricing or technical error has occurred, or accepting the transaction would be unlawful.

Where payment has already been collected for an order that cannot be fulfilled, the appropriate refund will be issued.

6. Payments

Payments are processed through the payment methods made available during Shopify checkout.

Customers are responsible for providing accurate payment and billing information.

Papa Diaries does not directly store complete payment card details processed through Shopify's payment infrastructure.

7. Delivery

Papa Diaries currently delivers within Malta.

Delivery options, charges and relevant arrangements are described in our Shipping & Delivery Policy and will be communicated before completion of the order where required.

8. Returns, Withdrawal and Refunds

Customers purchasing online may have statutory rights to withdraw from their purchase.

Our cancellation, return and refund procedures are explained in our Refund & Returns Policy.

Nothing in these Terms restricts mandatory consumer rights.

9. Jewellery Care

Jewellery may naturally change in appearance over time depending on the material, finish, frequency of wear, storage and exposure to moisture, perfumes, cosmetics, chemicals or other environmental factors.

Customers should follow the care information provided with the product or on our Jewellery Care page.

Care information does not limit statutory rights relating to goods that are faulty or do not conform to the contract.

10. Promotions and Discount Codes

From time to time, Papa Diaries may offer promotional codes or discounts.

Promotions may be subject to conditions including minimum order values, expiry dates, eligible customers or usage limits.

The applicable conditions will be communicated with the promotion.

Discounts cannot be exchanged for cash unless expressly stated otherwise.

You must not misuse the website, attempt unauthorised access, interfere with its operation, introduce malicious software, or use the website for unlawful purposes.

Unless otherwise stated, Papa Diaries branding, original written content, graphics and other original website material belong to Papa Diaries or are used with appropriate permission.

They may not be reproduced or commercially exploited without permission except where permitted by law.

Our store is hosted and supported by Shopify and may use other third-party services to provide payments, reviews, analytics, delivery or other functionality.

Your use of certain third-party services may also be subject to their respective terms and privacy practices.

14. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or restricts rights granted to consumers under applicable law.

Papa Diaries will not be responsible for losses arising solely from events outside our reasonable control except where applicable law provides otherwise.

Personal information is processed in accordance with our Privacy Policy and applicable data protection law.

Consumers may also have access to consumer complaint, conciliation or alternative dispute resolution mechanisms provided by the Malta Competition and Consumer Affairs Authority (MCCAA).

These Terms are governed by the laws applicable in Malta.

Nothing in this provision deprives a consumer of mandatory protections available under applicable consumer law.

We may update these Terms when necessary to reflect changes to our store, services or legal obligations.

The latest version will be published on our website with the updated date.
